If you hold dual U.S.-Kenyan citizenship, you can own freehold land in Kenya. If you are a U.S. citizen without Kenyan citizenship, you can own leasehold property — typically on 99-year renewable leases.

    Required for any Kenyan property transaction. You can apply online from anywhere in the world via the KRA iTax portal. Process takes 3–14 days, costs nothing, and is the simplest step.

    Engage a lawyer in Kenya

    Commission a licensed surveyor

    If anything is unclear on the ground, your lawyer instructs a Survey of Kenya-licensed surveyor to carry out a rebeaconing: physically re-establishing the boundary beacons, obtaining the Survey of Kenya map, and verifying GPS beacon coordinates. The surveyor issues a beacon certificate — and a full surveyor's report at client and seller's joint request. Cost: approximately KES 15,000–20,000 for ~1 acre nationally.

    Issue a Power of Attorney

    A documented Power of Attorney appoints someone in Kenya — typically your lawyer — to sign documents on your behalf. Drafted in your country, notarised, and registered in Kenya.

    Title verification and transfer

    Your lawyer traces the title history all the way back to the original green card (allotment) — not just the current title. Searches are conducted at both the local Lands Registry and the Land Court; for town plots, title histories are held in Nairobi and must be checked there. The lawyer takes physical possession of the title from the seller to verify authenticity. Re-issued titles need a clear, documented explanation — treat them as a red flag without one. Once all checks pass, your lawyer drafts the sale agreement, registers the transfer via the Ardhisasa portal, and the new title is issued in your name.

    Notarise documents in the United States

    Your Power of Attorney is signed and witnessed in the United States (notary, solicitor, or commissioner of oaths as applicable), then authenticated for use in Kenya. The Kenya Embassy in Washington, D.C. (and consulates in Los Angeles, New York, and Houston) supports diaspora property investors through the Commerce Department.
