Power of Attorney for Kenyan Property Purchases
A Power of Attorney lets your lawyer in Kenya sign documents on your behalf so the entire transaction can complete without you flying back. Here is how to issue one correctly.
What a Power of Attorney Actually Does
A Power of Attorney (PoA) is a legal instrument by which you (the donor) authorise another person (the donee) to act on your behalf in specific matters. In Kenyan property purchases, the PoA typically authorises your lawyer or a trusted family member to sign the sale agreement, the transfer instrument, and the relevant tax filings on your behalf.
PoAs in Kenya are governed by the Powers of Attorney Act (Cap. 30). The instrument must be in writing, signed by the donor, attested by witnesses, and registered with the Lands Registry if it relates to land. PoAs executed abroad must additionally be notarised in the country of execution and authenticated for use in Kenya.

Decide on Special vs General
A Special Power of Attorney is limited to a specific transaction (e.g. “purchase of L.R. 12345/89, Karen, Nairobi”). A General Power of Attorney covers broad authority over your affairs. For a single property purchase, always use a Special PoA — it limits the donee’s authority and your exposure.
Have the PoA drafted by a Kenyan lawyer

Print two originals. Sign in front of a notary public in your country of residence. The notary will witness your signature, affix their seal, and provide a notarisation certificate. Notary fees vary: USA ~$15–40, UK ~£50–150, Canada ~CAD$50–100, UAE ~AED 100–300.
Red flags — walk away if- Signing without a notary present (only acceptable if your jurisdiction recognises the PoA without notarisation, which is rare)

Authenticate the notarisation for use in Kenya
Kenya is a party to the Hague Apostille Convention. In countries that are also parties (USA, UK, Canada, UAE all qualify), the notarisation is authenticated by an Apostille from the relevant authority — the State Secretary in the US, the FCDO in the UK, Global Affairs in Canada, the Ministry of Foreign Affairs in the UAE. The Apostille replaces older consular legalisation processes and is faster.
Red flags — walk away if- Skipping authentication — the Lands Registry will reject an unauthenticated PoA

Courier the originals to Kenya
Both signed-and-apostilled originals go to Midikira LLP by international courier (DHL, FedEx, UPS — typically 3–7 business days from the US, UK, Canada, UAE). One original is registered with the Lands Registry; the second is retained for the transaction file.
Register at the Kenyan Lands Registry
Midikira LLP lodges the apostilled PoA at the Lands Registry. Registration cost is currently KES 500. Once registered, the PoA can be used in any registered land transaction in Kenya. Registration typically completes within 5–10 working days.

When to Issue, When to Revoke
Issue the PoA after you have selected the property and Midikira has confirmed clean title via the Ardhisasa search, but before you sign the sale agreement. This sequence keeps the PoA aligned to a real, verified transaction.
Revoke the PoA immediately after the transaction is complete and the title transfer is registered in your name. Revocation is a separate instrument, also registered at the Lands Registry, that formally withdraws the donee’s authority. Never issue a General PoA to anyone for property purposes. Never issue a Special PoA to someone you have not vetted independently. The PoA is the legal instrument with the highest abuse potential in Kenyan property practice — used carefully, it is also the instrument that makes diaspora buying viable.
