Why Now

Remittance Corridor

Major Kenyan diaspora hubs in Canada: Toronto, Mississauga · Calgary, Edmonton · Ottawa, Vancouver.

What You Can Own

Dual Kenyan-Canadian citizens have full freehold ownership rights in Kenya. Canadian citizens without Kenyan citizenship can own leasehold property on 99-year renewable leases.

  • Kenyan citizens in Canada retain full property rights in Kenya, including freehold ownership.
  • Canada permits dual citizenship, and so does Kenya — Kenyan-Canadian dual citizens have full rights in both jurisdictions.
  • CRA requires reporting of foreign property over CAD 100,000 cost basis on Form T1135. Kenyan rental income is reportable on your Canadian tax return; the Canada-Kenya tax treaty provides relief on most categories.

The Canada → Kenya Buying Process

Six core diaspora steps, plus the country-specific notarisation step that gets your paperwork recognised in Kenya.

  1. 1

    Get your KRA PIN

Required for any Kenyan property transaction. You can apply online from anywhere in the world via the KRA iTax portal. Process takes 3–14 days, costs nothing, and is the simplest step.

  2. 2

    Engage a lawyer in Kenya

Your lawyer is your eyes, your hands, and your legal protection on the ground. ArdhiHome maintains a vetted network of independent conveyancing lawyers, including Midikira LLP, and can facilitate an introduction.

  3. 3

    Find a verified property

Browse ArdhiHome’s verified listings. Every property is tied to an EARB-licensed agent and a vetted developer where applicable.

  4. 4

    Commission a licensed surveyor

If anything is unclear on the ground, your lawyer instructs a Survey of Kenya-licensed surveyor to carry out a rebeaconing: physically re-establishing the boundary beacons, obtaining the Survey of Kenya map, and verifying GPS beacon coordinates. The surveyor issues a beacon certificate — and a full surveyor's report at client and seller's joint request. Cost: approximately KES 15,000–20,000 for ~1 acre nationally.

  5. 5

    Issue a Power of Attorney

A documented Power of Attorney appoints someone in Kenya — typically your lawyer — to sign documents on your behalf. Drafted in your country, notarised, and registered in Kenya.

  6. 6

    Title verification and transfer

Your lawyer traces the title history all the way back to the original green card (allotment) — not just the current title. Searches are conducted at both the local Lands Registry and the Land Court; for town plots, title histories are held in Nairobi and must be checked there. The lawyer takes physical possession of the title from the seller to verify authenticity. Re-issued titles need a clear, documented explanation — treat them as a red flag without one. Once all checks pass, your lawyer drafts the sale agreement, registers the transfer via the Ardhisasa portal, and the new title is issued in your name.

    Notarise documents in Canada

Your Power of Attorney is signed and witnessed in Canada (notary, solicitor, or commissioner of oaths as applicable), then authenticated for use in Kenya. The Kenya High Commission in Ottawa serves Kenyan diaspora across Canada, with consular outreach in Toronto and Calgary.

Canada → Kenya FAQ

If your specified foreign property — including Kenyan real estate — exceeds CAD 100,000 in cost basis at any point in the year, you must file CRA Form T1135. Rental income from the Kenyan property is reportable on your Canadian return regardless of value. Consult a Canadian accountant familiar with the Canada-Kenya tax treaty for full guidance.
